Terms of Service

By accessing or using any service, platform, diagnostic tool, or digital property operated by IAMK Digital, you confirm that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree to these terms in full, you must immediately discontinue use of our services and digital environments.

IAMK Digital provides strategic technology consultancy, web and application development, and creative brand identity services as defined in individual service agreements or statements of work (SOW). Clients agree to provide accurate data, timely access to required systems, and active review feedback necessary for project completion.

Fees for services are structured according to agreed project milestones, retainer schedules, or fixed-scope proposals. Payments are due within the terms specified on invoices. Late payments may incur interest charges or result in temporary suspension of ongoing work.

All pre-existing tools, frameworks, methodologies, and proprietary systems developed by IAMK Digital remain the exclusive intellectual property of IAMK Digital. Upon full payment, clients receive a non-exclusive, non-transferable licence to use the delivered work product. Source code, design systems, and architectural blueprints are transferred only when explicitly stipulated in the engagement agreement.

To the maximum extent permitted under applicable Malaysian law, IAMK Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our services. Our total aggregate liability shall not exceed the fees paid by the client in the three (3) months preceding the event giving rise to the claim.

IAMK Digital reserves the right to update these Terms of Service at any time. Continued use of our services following a published revision constitutes acceptance of the updated terms. Either party may terminate an engagement with 30 days written notice. IAMK Digital may terminate immediately in the event of a material breach, non-payment, or conduct deemed harmful to our team or reputation.

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration under the rules of the Asian International Arbitration Centre (AIAC), Kuala Lumpur.

All formal legal notices, compliance inquiries, and contractual correspondence must be directed to IAMK Digital in writing via our Let's Connect panel or through our registered business address. We acknowledge and respond to all legal correspondence within 5 business days. For general support queries, our team responds within 24 hours.
